The High Court Judge in the northern city of Makeni, Hon Justice Allieu John Bosco was on Thursday March 10, 2016 said to be out of the district and could not preside over the petition case of the Alliance Democratic Parry (ADP) filed against Honourable Alhaji Ibrahim Ben Kargbo, NEC and the ruling APC party.
The Chairman and leader of the ADP, Mr. Mohamed Kamarainba Mansaray through his solicitor Emmanuel Saffa Abdul Esq., in the petition filed in the registry of the Makeni High court, is seeking leave of the court to rendered the December 12, 2015 by-election void which went in favour of Alhaji Ibrahim Ben Kargbo.
Lawyer Abdulai Esq. is also asking the court whether it was the right procedure followed by the Respondent (Hon. Alhaji Ibrahim Ben Kargbo) to be nominated by his party as Parliamentary candidate whilst he was at a time collecting salary from the consolidated revenue fund as Special Adviser to President Koroma.
He is also requesting the court to tell whether the National Electoral Commission (NEC) did follow the right procedure in conducting the December 12th by-election as the law demands.
Meanwhile, investigation conducted on the absence of the Judge revealed that all Judges in Sierra Leone were said to have gone to Freetown for a workshop. The matter has been adjourned to the 31st March 2016.
